CropLife Africa Middle East aisbl (hereinafter referred to as “CropLife Africa Middle East” is an international not for profit association (AISBL), with its registered office at rue Théodore De Cuyper 100, 1200 Woluwe-Saint-Lambert in Belgium and which is registered under number 0478.659.861.

As many other organizations, CropLife Africa Middle East collects and processes certain information about individuals. CropLife Africa Middle East is highly concerned about the compliance with the requirements of the privacy legislation applicable in Belgium and of the General Data Protection Regulation (GDPR).

In that respect, it is fundamental for us to provide you with information about the processing we may perform on your data. This privacy policy sets out how CropLife Africa Middle East uses and protects your personal data.

All information provided will only be used in accordance with this privacy policy. We may change this policy by updating this page. Please check regularly to be informed of any modifications. This policy is effective from January 2019.

1. What personal data do we collect and process and why?

Under the GDPR, “personal data” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identify of that natural person.

CropLife Africa Middle East may collect and process the following categories of personal data to the extent necessary to function and to carry out its activities. The type of personal data which are collected may depend on the individuals and their relation to CropLife Africa Middle East.

1.1. People working for CropLife Africa Middle East

If you are working for CropLife Africa Middle East or you are part of a legal entity which works for CropLife Africa Middle East , we may process your personal data (such as name, surname, private phone number, email address, financial data (bank account) and security related data (login and password to the Restricted area of our website)) for the purpose of administration (i.e. to manage CropLife Africa Middle East and to grant access to the Restricted area of our website) .

Those data are processed based on our legitimate interest to conduct a business or on the performance of the contract we signed with you. In any case, your personal data are only processed as long as you work or you are part of a legal entity which works for CropLife Africa Middle East and after, as long as it is legally required.

1.2. Members of CropLife Africa Middle East and Board of Directors

If you are part of a legal entity which is a member of CropLife Africa Middle East , we may collect your personal data (name, surname, title, phone number, email address, other information on the ID card and security related data (login and password to the Restricted area of our website)) for the purpose of administration of the members of the association (i.e. to manage CropLife Africa Middle East , the Industry Committee of which you could be a part of, to grant access to the Restricted area of our website and more generally to provide our services to the members) or of sharing information related to CropLife Africa Middle East and its activities.

If you are a member of CropLife Africa Middle East ’s Board of Directors or part of a legal entity which is a member of CropLife Africa Middle East ’s Board of Directors, we may also process your personal data (name, surname, title, phone number, email address, other information on the ID card and security related data (login and password) for the purpose of administration of the members of the Board of Directors (i.e. to manage CropLife Africa Middle East and to grant access to the Restricted area of our website) or of sharing information related to CropLife Africa Middle East and its activities.

Those processing are based on our legitimate interest to share information (freedom of expression and information), to ensure a good functioning of the association (freedom to conduct a business) and on our obligations under the Law of 27 June 1921 on non-profit associations, foundations and international non-profit associations.

Your data are only processed as long as you are part of a legal entity which is a member of CropLife Africa Middle East or you are a member or part of a legal entity which is a member CropLife Africa Middle East ’s Board of Directors. In compliance with the law, we will communicate the necessary data to the Registry of the Commercial Court, through our counsel.

1.3. Donors and contract partners

If you are working for a international organization / partner, we may process your personal data (such as name, surname, title, private and professional address, private and professional phone numbers and financial data (bank account)) for the purpose of administration.

Such processing is based on the performance of the contract we signed with the legal entity you are working for. Your personal data are only processed as long as you are working for a donor/contract partner.

1.4. Spray Services Providers (SSP)

If you are a Spray Services Provider (hereinafter “SSP”), you have consented to the processing of your personal data (such as name, surname, address, phone number, results to tests and pictures) for the purposes of administration of the SSP and communication towards our members at national level so they can contact you for work related reasons. Your personal data are only processed as long as you are an active SSP.

We will not sell your data. We may communicate some of your data to our donors and contract partners, our consultants and members or to other third party if we are required by law to do so.

1.5. Suppliers/Newsletter subscribers/Business contacts

As part of its general mission, CropLife Africa Middle East processes personal data for the following purposes:

  • For supplier administration purpose, if you are working for one of our suppliers, we may process your personal data (such as name, surname, title, private and professional addresses, past address, private and professional phone numbers) based on our legitimate interest to ensure a good functioning of the association (freedom to conduct a business). Your personal data are only processed as long as you work for one of our suppliers.
  • For the purpose of communication of information about our activities and developing and maintaining professional and public relationship, if you have subscribed to the newsletter, we process your personal data (such as name, surname, email address) based on our legitimate interest to exercise our right of information and expression and to ensure a good functioning of the association (freedom to conduct a business). Your data are only processed as long as you wish to receive the newsletter.
  • For the purpose of communication of information about our activities and developing and maintaining professional and public relationship, if you have subscribed to the newsletter, we process your personal data (such as name, surname, email address) based on our legitimate interest to exercise our right of information and expression and to ensure a good functioning of the association (freedom to conduct a business). Your data are only processed as long as you wish to receive the newsletter.

    Your personal data are only processed as long as you are working for one of our NGO group contacts or one of our government contacts.

1.6. For all individuals

We will not sell your data. We may provide your personal data to companies that provide services to help us with our business activities (our processors, such as our IT provider (HostPoint) or our provider managing the newsletter (Prefix Technologies (Pty) Ltd.). These companies are authorized to use your personal data only as necessary to provide these services to us.

We may transfer your personal data as necessary for the purpose described above to locations outside the jurisdiction in which you provide them. This may entail a transfer of your information from a location within the European Economic Area (the “EEA”) to outside the EEA, or from outside the EEA to location within the EEA.

The level of information protection in countries outside the EEA may be less than that offered within the EEA and is not recognized by the European Commission as providing an adequate level of data protection. Where this is the case, we implement standard contractual clauses approved by the European Commission.

2. Processing linked to our website (www.croplifeafrica.org)

For the Contact Form: we process personal data (such as company name, name, address, telephone number, fax number and email address) of individuals who register themselves on CropLife Africa Middle East website by the mean of the contact form in order to receive information from CropLife Africa Middle East. CropLife Africa Middle East only processes such data for the purpose of addressing the requests of the individuals.

3. What are your rights as data subjects and how to exercise them?

As data subject, you have the following rights with respect to personal data we hold about you, subject to applicable legal restriction:

  • Right of access to your personal data;
  • Right to rectification of incorrect or incomplete personal data;
  • Right to erasure of your personal data;
  • Right to restriction of processing of your personal data;
  • Right to data portability; i.e., the right to receive the personal data concerning you in a structured, commonly used and machine-readable format and to transmit those data to another controller;
  • Right to object to all or part of the processing, when legally allowed;
  • Right not to be subject to automated individual decision-making, including profiling within the limits set out by the law;
  • Right to withdraw consent at any time when we process your personal data based on your consent;
  • Right to lodge a complaint with a supervisory authority in the EU.

If you wish to exercise any of these rights or if you are not satisfied about how we protect your privacy, you should address your request by email together with a proof of your identity (e.g. a copy of your ID from which you should hide unnecessary information), to CropLife Africa Middle East at: [gdpr@croplifeafrica.org]. By sending us such proof of your identity, you consent to the processing of data it contains. We will only use such information to verify your identity. We will keep such data only for the time necessary to address your request, after which we will delete them.

Individuals will not be charged for subject access requests, except if the requests are manifestly unfounded or excessive (e.g. repetitive). In such case, [gdpr@croplifeafrica.org] may reserves the right to refuse to act on the request.

CropLife Africa Middle East will aim at responding to data subjects’ requests without undue delay and in any event within 1 month of receipt of the request.
